Introduction

The contract of motor insurance is between you and us (Highway Motor Policies at Lloyd's and Highway Insurance Co. Ltd.).
It includes your signed proposal form, this insurance document, the schedule, the certificate of motor insurance and any endorsements.

So that you understand what you are covered for, please read this booklet, the schedule and certificate carefully. You should pay special attention to the general exclusions, the general conditions, and any endorsements.

If any part of this documentation is incorrect of if your cover does not meet your needs or you have any questions, you should contact us or your insurance adviser.

Your Insurance

This document is a legally binding contract of insurance between you and us (Highway Motor Policies at Lloyd's and Highway Insurance Co. Ltd.). The contract is based on the information you gave us in the proposal form which you signed or a statement of fact that you have made.

Highway Motor Policies at Lloyd's (HMP) and Highway Insurance Company Limited (HICO) are each responsible for a different percentage of this insurance. They do not have joint financial responsibility. Details of the proportions can be obtained on request to us. HMP is only ever liable for its percentage of this insurance and not for the separate liability of HICO. Similarly, HICO is only responsible for its individual proportion of liability and not for the separate cover given by HMP.

We agree to insure you under the terms, conditions and exceptions contained in this booklet or any endorsements that apply to this booklet. You are insured for any liability, loss or damage that occurs during any period of insurance which you have paid, or agreed to pay a premium for.

Unless we have agreed otherwise with you, this insurance is governed by English law.

Guidance notes

We rely on the information you gave us being correct and complete. If it was not, you may not be covered by this insurance.

You must tell us about any change in the information you gave us. If you do not, you may not be covered by this insurance.

You must also tell us about any changes you want us to make to this document.

Important notice

You must tell us as soon as possible about changes which affect your insurance.

Here are some examples of changes you should tell us about.

  • A change of car or any extra car.
  • A change of address (including details of where your car is parked overnight).
  • A change of job by you or any other driver. This includes getting part-time work or having no work.
  • Any change in what you use your car for.
  • All mechanical or cosmetic changes you make to the car.
  • Any new driver who you want to cover.
  • Details of any motoring offences which any person allowed to drive has been charged with or convicted of including any fixed penalties.
  • Details of any person who is allowed to drive your car and who now suffers from any new illness or physical condition.
  • Details of any accidents, claims or losses involving any person allowed to drive, whether they happen in your car or any other vehicle.
  • A change in the person who uses your car the most.

If you do not tell us about changes, your insurance may not cover you fully or at all.

Definitions

The following words or phrases have the same meaning whenever they appear.

The certificate of motor insurance
A document which is legal evidence of your insurance. It is part of the contract of insurance and you must read it with this booklet. It shows who may drive your car, what they may use your car for and the period of cover. It also shows which cars we are insuring.

Guidance notes

You must give us full details of any change which could affect your insurance. If you do not, you may not be covered by this policy.
We suggest that you keep a written record of any information you give us or your insurance adviser. If you are not sure whether you need to tell us about certain facts you should contact us or your insurance adviser.
You must report all accidents to us, even if you do not make a claim.

Conditions
These describe the responsibilities and procedures that you must follow.

Contract of motor insurance
This is made up of our signed proposal form, this booklet, the schedule, the certificate of motor insurance and any endorsements.

Endorsements
These alter your insurance cover. You should check the schedule to see which apply to you.

Exceptions
These describe what this insurance does not cover.

Excess
This is an amount you have to pay towards each claim you make under this insurance.
There may be more than one excess.

An insurer authorised by the Financial Services Authority.

Period of insurance
This is the period of time covered by this insurance, as shown on the certificate of insurance and schedule.

Personal belongings
Property in the car which you wear or use in everyday life which belongs to you or anyone travelling in your car.

Schedule
The document that shows the cars we are insuring and the cover which applies. You should read it with this booklet and the certificate of insurance.

UK
This means England, Scotland, Wales, Northern Ireland, the Isle of Man and the Channel Islands. It also includes travelling by sea, air or rail between these places.

We, us
Highway Insurance Co. Ltd.

You, your
The person named as 'the insured' in the schedule, or as 'the policyholder' in any certificate of motor insurance or renewal notice that applies to this insurance.

Your car
Any car shown in the schedule or described in the current certificate of motor insurance.

Proposal Form or Statement of Fact
The documents completed by you or on your behalf by your insurance advisor and contains information you gave at the time insurance was arranged on which we have relied.

To make this booklet easier to understand, we have explained certain words and phrases.

The certificate of motor insurance shows who may drive and describes what you may use your car for.

You will not be covered by this insurance if you have broken a condition You must tell us about changes to the information shown on the documents which make up your contract of insurance. If you do not, you may not be covered by this insurance.
You must tell us before you change your car. If you do not, you will not be covered by this insurance.

Cover

Your most recent schedule shows what you are covered for. The different kinds of cover are listed below.

  • Comprehensive (shown as COMP) - Sections 1, 2, 3, 4, 5, 6, 7 and 8 apply.
  • Third party fire and theft (shown as TPFT) - Sections 1, 3, 6, 7 and 8 apply.
  • Third party only (shown as TPO) - Sections 1, 6, 7 and 8 apply.
  • Fire and theft (shown as FTO) - Sections 3, 7 and 8 apply.

Remember

  • The general terms, conditions and exceptions apply to all sections of this insurance.
  • You will also have the cover described in any endorsement that is shown on your schedule.

Use
The insurance only covers you if you use your car in the way described in your certificate of motor insurance and any endorsement.

As well as the exclusions in your certificate of insurance, we will not cover you for the following.

  • Any use connected with the motor trade, unless this use is described in your certificate of insurance.
  • Hiring out your car for money.
  • Carrying passengers or goods for money.
  • Racing or being in any contest or speed trial (apart from treasure hunts).
  • Or use on any form of race track.

Your schedule shows what you are covered for. Find the cover you have and see the sections of this document that apply to you.

Your insurance will only cover you if you pay all the premiums on time.

The different types of cover are shown above.

The general conditions and exceptions apply to all sections of the insurance.

The certificate of motor insurance describes what you can use your car for (under the heading 'limitations as to use').

You can accept money from passengers if you are giving them a lift as long as:-

  • you do not make a profit;
  • you are not carrying them as part of a business.

Section 1 - Your liability to other people

We will insure you against everything you legally have to pay to claimants for damages costs and expenses if they arise from a claim caused by an accident while you are driving or in the charge of the insured car if.

  • you kill or injure other people; or
  • you damage their property.

Driving other cars

If your certificate of motor insurance says so we will also insure you to drive any private car that you do not own and have not hired under a hire purchase or leasing agreement. However, we will not insure you against any loss of or damage to that car. Also we will not insure you in the following circumstances:

  • if you do not have the owner's permission to drive the car.
  • if you are covered by any other insurance to drive the car.
  • while you are outside of the United Kingdom.
  • if you no longer have possession of the insured car or it has been damaged so much that it is not worth repairing or has been stolen.

Other people

We will also insure the following people.

  • Any person you allow to use your car as long as your certificate of motor insurance says they can. The person must not be excluded from driving or using your car by an endorsement, exception or condition.
  • Any person who causes an accident while they are travelling in or getting into or out of the insured car.
  • Your employer or business partner (if your certificate of motor insurance allows business use).
  • If anyone covered by this insurance dies, we will cover their legal representative to deal with any claims made against that person's estate.

Guidance notes

We will insure you against claims made by other people for death, injury or damage to their property while you are driving or using your car.

This section does not cover any loss or damage to the car you are using.

We will also cover you if you are using someone else's car (but only if your certificate says you can).

We will also insure other people while they are using your car (but only if your certificate says they can).

Legal costs

If we agree in writing we will pay for the following legal fees if they arise from a claim caused by an accident that is covered under this insurance.

  • The solicitor's fee for representing anyone we insure at a court of summary jurisdiction, fatal accident enquiry or coroner's inquest.
  • The reasonable costs of legal services we arrange for defending an insured person against a charge of manslaughter or causing death by dangerous driving.

Emergency medical treatment

We will pay for emergency medical treatment after an accident involving any car which this insurance covers.

The Road Traffic Act says we must provide this cover. If this is the only payment we make, it will not affect your no claims bonus.

By law the person who owns the car must pay the cost of emergency treatment. They should pass the bill for emergency treatment to us straight away along with a filled in accident report form.

European Union (EU) compulsory cover

We will provide the minimum insurance to allow you to use any car covered under this insurance:

  • in any country which is a member of the EU; and
  • in any other country which has made arrangements to meet the minimum insurance needed in the EU. This section does not include cover for 'Driving Other Cars' (see pages 7 and 21).

If you need the full cover shown in the schedule, you must write and tell us about the journey you are going on. The Driving Abroad section on page 19 has more information about this.

Guidance notes

If we agree in writing, we will pay legal costs and expenses arising from a claim made because of an accident that is covered by this insurance.

If we first agree in writing we will pay the solicitor's fee for representing or defending anyone we insure.

We will pay the compulsory fee for emergency medical treatment after an accident.

If we only pay a claim for emergency medical treatment this will not affect your no claims bonus.

Your policy automatically gives you the minimum insurance you need to use your car in the EU and certain other countries. This minimum cover varies between countries. To make sure you have the full cover shown in the schedule, you should extend your cover when you travel abroad. The driving abroad section on page 19 has more information about this.

Towing

We will insure you under this section while any car covered by this insurance is towing a caravan, trailer or broken-down car. The cover will apply as long as the towing is allowed by law, and the caravan, trailer or broken-down car is attached properly to your car by towing equipment manufactured for this purpose.

This section of your insurance does not cover any of the following.

  • Damage to or loss of the caravan, trailer or broken-down car.
  • Damage to or loss of property being carried in or on the caravan, trailer or broken-down car.
  • A caravan, trailer or broken-down car that you are towing for profit.
  • Death or injury to any person being carried in or on or getting into or out of a caravan, trailer or broken down-car.

Guidance notes

You can tow a caravan, trailer or a broken-down car. We only cover you for claims against you because of damage or injury arising from the towing.

We do not provide any cover for loss of or damage to the caravan, trailer or broken-down car, or any of their contents.

You must not tow for profit.

Exceptions to section 1

This section of your insurance does not cover:

  • anyone who does not have a driving licence;
  • anyone who is disqualified from driving;
  • anyone who does not meet the conditions and limitations of their driving licence;
  • anyone who does not meet all the conditions of this insurance;
  • anyone who is covered by another insurance;
  • loss of or damage to any car covered by this insurance;
  • loss of or damage to any property belonging to (or in the care of) any driver or passenger who is making a claim under this section;
  • death of or bodily injury to the person in charge of the car.

Guidance notes

We will not cover any person who:

  • knows that the driver does not have a licence to drive the car or is disqualified from driving;
  • does not take reasonable steps to make sure the driver meets any licence conditions. (For example a provisional licence holder should be accompanied by a full licence holder);
  • does not meet all the conditions of this insurance;
  • can claim for the same loss under any other insurance.

Section 2 - Cover for accidental damage
(excluding fire or theft)

This cover applies only to the insured car.

  • We will cover you for loss of or damage to your car. This includes its standard accessories and spare parts if you keep these in or on your car or in your garage.
  • We will also pay up to £150 for loss of or damage to your car's fitted audio equipment. This cover does not include tapes, cassettes, compact discs, citizen-band radios, phones or phone equipment.

Your contribution to a claim (the excess) - If an excess is shown in the schedule or on any endorsement that applies to this insurance, you will have to pay that amount for each claim you make. More than one excess may apply.
You will also have to pay an extra excess for a young or inexperienced driver.

Young or inexperienced driver excess

If your car is damaged while a young or inexperienced person is in charge of it, you will have to pay part of the cost of each claim as follows.

This excess is on top of any other excess which you may have to pay.

We describe the terms, conditions and exceptions that apply to this section on pages 13 to 15 of this booklet.

Guidance notes

This section shows how we insure your car against loss or damage.

As well as your car, this insurance covers your car's standard accessories and spare parts as long as you keep them in your car or garage.

We also cover loss of or damage to audio equipment. The most we will pay is £150.

The excess is the amount you have to pay for every claim for loss of or damage to your car. (For example, if your car costs £200, and you have a £50 excess you pay £50 and we pay £150.) More than one excess may apply.

There are three kinds of excess.

  • A compulsory excess - this will apply if we are insuring certain types of drivers, or cars.
  • A voluntary excess - sometimes you can choose to have an excess and we will give you a discount on your premium.
  • A young or inexperienced driver excess. This will depend on the age and experience of the driver.

Voluntary or compulsory excesses will be shown in your schedule and on any endorsement that applies to this insurance. The young or inexperienced driver excess will be on top of any other excesses which apply.

You should read the terms, conditions and exceptions to this section at the same time as you read this section (see pages 13 to 15).

Section 3 - Cover for fire and theft damage

This cover only applies to the insured car.

We will cover you for loss of or damage to your car that is caused by:

  • fire, lightning, self-ignition or explosion; and
  • theft, or attempted theft.

This includes standard accessories and spare parts if you keep them in or on your car or in your garage.

We will also pay up to £150 for loss of or damage to your cars' fitted audio equipment. This cover does not include tapes, cassettes, compact discs, citizen-band radios, phones or phone equipment.

Your contribution or excess

You must pay the first £100 if you claim under this section. This excess is on top of any other excesses which you may have to pay and which are shown in the schedule or on any endorsement that applies to this insurance.

Theft

If your car is stolen we will treat it as lost if you have still not got it back thirty days after you reported the theft to us. It must still be missing when we pay your claim.

We need a letter from the police to say that you reported the theft as soon as you discovered it. You must also send us your car keys.

If your car is stolen and you later get it back, you must tell us straight away.

We describe the terms, conditions and exceptions that apply to this section in pages 13 to 15 of this booklet.

Guidance notes

This section covers you for loss of or damage to your car from fire or theft.

We also cover you for damage caused by someone trying to steal your car.

The excess is the amount you have to pay for every claim for loss of or damage to your car. (For example, if your car costs £250 to repair you pay £100 and we pay £150.) More than one excess may apply.

You must report any theft to us as soon as possible. ('How to make a claim' on page 29 has more information about this.)

It is important that you tell us straight away if you get your car back.

You should read the terms, conditions and exceptions to this section at the same time as you read this section (see pages 13-15).

Terms, conditions and exceptions to sections 2 and 3

How we may pay your claim

We may:

  • pay for the damage to be repaired; or
  • give you an amount to replace the lost or damaged car or item; or
  • replace your car or any item.

The most we will pay

The most we will pay will be:

  • the market value of your car just before the loss or damage happened (including its accessories and spare parts);
  • the amount for which you have insured the car; or
  • the cost of repairing the car;

whichever is less.

If any lost or damaged part or accessory is no longer available, the most we will pay will be:

  • the cost shown in the manufacturer's last price list; and
  • the reasonable cost of fitting.

We will not pay for the whole cost of any repair or replacement which leaves your car in a better condition than it was before the loss or damage. If this happens you will have to pay part of the cost of repair or replacement.

Guidance notes

These are the ways we can choose to pay your claim.

The current market value of your car is the most we will pay.

This is the cost of replacing your car with one of the same make, age and condition (but we will not pay VAT and excise tax). We will usually ask an engineer to give us advice on the value of your car if you make a claim.

You will have to pay something towards a repair or replacement if your car is in a better condition after the work than it was before (for example, if we replace your worn tyres, exhaust or battery).

Financial interest

If your car is part of a hire purchase or leasing agreement or belongs to someone else, we will normally settle your claim with the car's legal owner.

Repairs after an accident or theft

  • If you can't drive your car after an accident or theft that is covered by this insurance, we will pay the reasonable cost of protecting it and getting an authorised agent to take it to the nearest suitable repairer or another safe place. We will also pay for it to be brought back to your address shown in the schedule.
    Unless we agree first, we will not pay the cost of any transport outside the country in which the damage or loss occurred.
  • You should not move the car if this could cause further damage. We will not cover you for any damage caused in this way.
  • We may arrange a safe place to keep your car while it is waiting to be repaired or disposed of.
  • No new part or accessory should be ordered on your behalf or supplied to you unless we agree first.
  • If we think that the estimate for repairing your car is unreasonable, we may ask for your car to go to another repairer.

Total loss (Write off)

If we choose to pay you the market value of your car or the value of the car shown in the schedule you must send us the certificate of motor insurance ' the vehicle registration document and Department of Transport test (MOT) certificate if the car needs one and keys before we pay your claim.

Once you accept our offer, this insurance will end for that car. The car then becomes our property.

If we choose to treat your car as a write off, we may move it somewhere safe.

Guidance notes

If the car belongs to someone else or is hired or leased to you, we may settle your claim with the owner.

Repairs can be arranged quickly. See 'How to make a claim' on page 29.

If you can't drive your car, we will pay the cost of taking it to the nearest suitable repairer.

We may arrange for your car to go to another repairer if we cannot agree repair costs with the garage you have chosen.

If we treat your car as a write off, you must send us the documents we ask for before we will make any offer.

Once you accept our offer for your car, this insurance will end for that car.

Exceptions to sections 2 and 3

Sections 2 and 3 of your insurance do not cover any of the following.

  • Wear and tear, mechanical, electrical, electronic and computer failure, breakdowns or breakages.
  • Damage to tyres unless caused by an accident to your car.
  • Damage to or loss of car phones.
  • Compensation for you not being able to use your car unless this is provided as an extra benefit by this insurance.
  • Loss from repossessing the car and returning it to its rightful owner.
  • The value of your car reducing as a result of damage, whether repaired or not.
  • Any extra parts or accessories beyond the amount you have insured the car for.
  • Damage caused by frost, unless you have taken reasonable care to stop the damage happening.
  • Any excess that applies to this insurance.
  • Loss of or damage to the car as a result of someone taking it by fraud or trickery.
  • Loss of or damage to the car arising from any agreement or proposed transaction for selling or hiring this car.
  • Loss of or damage to your car or its contents by theft or attempted theft if you have not taken reasonable care to protect it.
  • Loss of or damage to your car if it has been left unlocked or with the keys in it or attached to it.
  • Loss of or damage to the car arising from it being taken or driven by a person who was not an insured driver under the policy but was a member of the policyholder's family or household, unless the policyholder can prove that the driver deliberately deprived the owner of the vehicle.
  • Compensation for any delay where we have to get new parts or accessories.
  • Any storage charges unless you tell us and we agree to pay for them.

Guidance notes

Loss or damage not covered under sections 2 and 3 is shown above.

It is important to follow the vehicle manufacturer's instructions to avoid liquid freezing in your vehicle.

You must take all reasonable precautions to avoid loss of or damage to your car. For example, you should take the keys out of the ignition and remove them completely when the car is empty and make sure that you do not leave possessions on display. You should close all the windows and lock all the doors. Always make sure that your immobiliser or alarm system is turned on if you have one and that you lock all your personal belongings in your boot.

Section 4 - Windscreen damage

We will pay for damage to your car's windscreen or windows as long as there is no other damage to your car.
We will not pay for damaged sunroofs, roof panels, lights or reflectors, even if they are made of glass.

You must pay the first £50 if you claim under this section, unless you have your windscreen or window repaired.

The most we will pay is:

  • £200 in any one period of insurance if the windscreen or window is replaced or repaired by our approved suppliers; or
  • £75 in any one period of insurance if any other supplier carries out the repair or replacement.

Unless the windscreen is cracked, shattered or the driver's vision is affected we will not pay extra for the work to be done outside normal hours.

If this is the only damage you are claiming for, your no claims bonus will not be affected.

Guidance notes

This section covers you for damage to glass in the windscreen or windows of your car if there is no other damage.

You will have to pay the first £50 of any claim you make under this section, unless your windscreen or window is repaired.

You can save money by having your windscreen repaired instead of replaced. When you contact the glass supplier, ask them to check the damage to see if it can be repaired.

A claim under this section will not affect your no claims bonus.

Section 5 - Extra benefits

1 Personal accident cover

If you or your husband or wife are injured or killed in a car accident, we will pay compensation. We will pay the amounts shown below if, within three months of the accident, it directly causes one of the following.

Death

£2,000

Total loss of one or more limbs

£2,000

Permanent blindness in one or both eyes

£2,000

The most we will pay in any one period of insurance is £2,000.
We will only make a payment if the injury or death:

  • is directly connected with an accident involving your car; or
  • happened while you or your husband or wife were travelling in or getting into or out of any other private motor car that you do not own and is not hired or leased to you.

We will pay the money to the injured person or to his or her legal personal representatives.

If the injured person is insured by us under any other motor insurance, we will only pay out under one contract.

This personal accident cover does not apply to any one of the following.

  • Anyone who is under 21 or is 75 or older at the time of the accident.
  • This insurance, if the insurance is in the name of more than one policyholder.
  • Death or bodily injury caused by suicide or attempted suicide, self-injury or by drugs, alcohol or anything taken or inhaled.
  • Death or bodily injury caused by disease, physical sickness or disability.
  • Anyone failing to keep to the law relating to using seat belts.

Guidance notes

This section provides benefits for you if you or your husband or wife are killed or suffer serious injuries in a car.

The most we will pay in any one period of insurance is £2,000.

The restrictions on this cover are shown above.

2 Personal belongings

We will pay up to £100 for personal belongings in your car, if they are lost or damaged because of an accident, fire, theft or attempted theft.

If the property is owned by someone else, you can ask us to settle the claim with the owner of the property.

This personal belongings cover does not apply to any of the following.

  • Personal belongings covered by any other insurance.
  • Money, stamps, tickets, documents, securities, jewellery or furs.
  • Goods or samples connected with your work or any other trade, or any container for these things.
  • Radios, cassette or compact disc players, tapes or discs, televisions, phones or phone equipment, citizen band radios and accessories.
  • Property which you have not taken reasonable care to protect from loss or damage.

 

3 Medical expenses

If you or your passengers are injured because of an accident involving your car, we will pay up to £150 for each person for any medical treatment.

Guidance notes

This section covers personal belongings in your car.

The most we will pay is £100.

We may settle a claim by paying the person who owns the property.

Things that we don't cover are shown above.

You must take reasonable care of your property. Do not leave it on show or in an unlocked or open car.

We will pay the costs of medical treatment for anyone who is injured in your car. The most we will pay is £150 for each person.

Section 6 - Driving abroad

Minimum cover

We will provide the minimum insurance to allow you to use any car covered by this insurance:

  • in any country which is a member of the EU; and
  • in other countries which have made arrangements to meet the minimum insurance specified by the EU.

This section does not include cover for 'Driving Other Cars' (see pages 7 and 21).

Full cover abroad

If you let us know before you go abroad and you pay an extra premium, we will extend the cover for your car for the time you are abroad. The insurance will then apply:

  • to any country which we have agreed to provide cover for; and
  • while the car is being transported by rail, sea or air between countries for which you have cover. If you are travelling by sea, it must be by a recognised sea route and the journey should not take longer than 65 hours.

We will usually give you an international motor insurance certificate (Green Card).

Cover for travel abroad does not apply to any of the following.

  • Section 8 (Driving other cars) and Section 5 (Extra benefits)
  • Your car unless it is being used for purposes described in the certificate of insurance.
  • Customs or excise duties.
  • Using your car abroad for more than a quarter of the period of insurance.

Guidance notes

This section describes the cover that is available when you take your car abroad. The minimum cover automatically provided by this insurance varies from country to country.

Unless you extend your cover by paying an extra premium, the cover you get is very restricted and will not include loss or damage to your car even if it would in this country.

Please tell us well in advance of your trip if you want to extend the cover under your insurance. We will normally give you a Green Card which will show the countries we have agreed to provide cover for. A Green Card is recognised internationally. It will help you prove that you have the minimum insurance cover you need in any country shown on the Green Card.

The restrictions on this cover are shown above.

Section 7 - No claims bonus

If you do not claim under this insurance, and no claim has been made against you we will allow a bonus from your renewal premium if the insurance is renewed for another year.

If the insurance covers more than one car, the no claims bonus will apply separately for each car.

You cannot transfer your no claims bonus to another person.

Guidance notes

We will automatically allow a no claims bonus each year as long as you don't claim under your policy.

This is a 'no claim bonus' and not a 'no blame bonus'. If we pay out under this insurance, we will reduce your no claims bonus even if an accident is not your fault (unless we get the money back from someone else).

Section 8 - General terms

When your car is not in use

If you want, you can reduce your insurance to cover loss or damage by fire or theft only. We will do this if your insurance cover is comprehensive or third party, fire and theft as long as:

  • the car will not be on a public road;
  • you will not be able to use your car for at least four continuous weeks;
  • you have not made a claim during the current period of insurance; and
  • you have returned the certificate of motor insurance to us.
  • you have not sold your car.

In return for the reduced cover, if you renew your insurance with us we will give you back part of the premium you paid for the last period of insurance. The amount will be 75% of the premium for the time the policy was suspended. When we work out how much we owe you, we use the date we get your certificate of motor insurance. However, we will not give you a refund if you can't use your car because of the loss or damage you are claiming for.

If this insurance covers more than one car, we will make any refund for each car separately.

 

Driving other cars

If your certificate of motor insurance says you can, we will also cover you under Section 1 (Liability to other people) while you are driving any private motor car that you do not own and have not hired under a hire purchase or leasing agreement.

We will not pay any claim under this section

  • if you do not have the owner's permission to drive the car;
  • for loss of or damage to any car you may be driving;
  • for any event which happens outside the United Kingdom;
  • if you are covered by another insurance to drive the car;
  • if the car shown in the schedule is no longer yours, it has been damaged so badly that it is not worth repairing or it has been stolen and you have not got it back.

Guidance notes

You can reduce the cover under this insurance to cover loss or damage by fire or theft only. Your car must be out of use for at least four weeks and must not be kept on a public road at any time.

The period of suspension will run from the date we get the certificate of motor insurance.

We will only refund part of your premium if you renew your insurance with us.

We will cover you for claims made for death or injury or damage to property if you are driving or using someone else's car (but only if your certificate of motor insurance says you can under the heading 'Persons or classes of persons entitled to drive').

Cancelling your insurance

You may cancel this insurance

You may cancel this insurance at any time by telling us in writing and sending us your certificate of motor insurance. If you or someone else has not made a claim in the current period of insurance, we will refund part of your premium using the chart below. When we work out the time you have been covered by this insurance we use the period from the date the insurance started to the date we receive your certificate of motor insurance.

We may cancel this insurance

We or our authorised agent may cancel this insurance by sending you seven days notice to your last known address. If we do this we will refund part of your premium for the period of insurance left after the cancellation date: if you or someone else has not made a claim under this insurance.

If we or our authorised agent cancel this insurance because you have not paid the premiums on time, we will not refund any part of the premium you have already paid. We will work out any outstanding premium charging for the time you have been covered by your insurance using the chart above. We will not pay any refund until we receive the certificate of motor insurance, or if you or someone else has made a claim under this insurance.

We will not refund any of your premium if the insurance is cancelled following a claim where we choose to treat your car as a total loss (write off).

Guidance notes

If you want to cancel your insurance, we may refund some of your premium. We will only cancel your insurance from the day we receive your certificate of motor insurance.

We may cancel your insurance by giving you seven days notice. It is an offence under the Road Traffic Act to keep your certificate after we have cancelled.

You must tell us or your insurance adviser if you have lost your certificate of motor insurance. You will have to confirm in writing that you have lost it.

General exceptions

These general exceptions apply to the whole of this insurance.

Your insurance does not cover the following.

1 Any accident, injury, loss or damage that happens while any car covered by this insurance is:

  • being used for a purpose which the car is not insured for;
  • in the charge of anyone who is not described in the certificate of motor insurance as a person entitled to drive;
  • is in the charge of anyone who is excluded from driving by an endorsement;
  • being driven by or in the charge of anyone who does not have a driving licence;
  • being driven by or in the charge of anyone who is disqualified from driving, who has not held a driving licence or who is prevented by law from holding one;
  • being driven by or in the charge of anyone who does not meet the terms and conditions of their driving licence;
  • being used while in an unsafe condition;
  • being kept or used without a current Department of Transport test (M.0.T) certificate if one is needed;
  • being used in or on restricted areas of airports or airfields or military bases. We will not pay for any claim involving an aircraft that happens within an airport or airfield.

2 Any liability that you have agreed to accept unless you would have had that liability anyway.

Guidance notes

These exceptions describe what your insurance does not cover. They apply to all sections of your insurance. Throughout this document you will also see exceptions which only apply to a particular section of your insurance.

The certificate of motor insurance describes what you can use your car for and the people who are allowed to drive it.

You must make sure any person who drives your car has a valid licence and meets all the conditions of it. For example, someone who only has a provisional licence must have a full-licence holder with them.

You may not be covered if you accept any liability under an agreement for the use of your car. Please contact us before you enter into such an agreement.

Your car must have a valid M.O.T.certificate and you may be asked to provide details to show your car was regularly maintained and kept in good condition.

3 Anyone who does not meet all the conditions of this insurance.

4 Any accident, injury, loss or damage caused directly or indirectly by:

  • war, invasion, act of foreign enemy, hostilities (whether war is declared or not) civil unrest, revolution, or any similar event (except where we need to provide cover to meet the relevant insurance law);
  • earthquake;
  • ionising radiation or radioactive contamination from nuclear fuel, or nuclear waste, or any risk from nuclear equipment;
  • pressure waves caused by aircraft and other flying objects; or
  • carrying any dangerous substances or goods (except where we need to provide cover to meet the relevant insurance law).

5 Any liability, loss or damage that happens outside the United Kingdom (apart from the minimum cover described in section 6).

6 Any proceedings brought against you outside the United Kingdom, unless they result from using your car in a country which we have agreed to extend this insurance to cover.

7 Any liability, injury, loss or damage caused directly or indirectly by:

  • pollution; or
  • contamination.

Unless the pollution or contamination is directly caused by one incident at a specific time and place during the period of insurance and is:

  • sudden;
  • identifiable;
  • not deliberate; and
  • unexpected.

We will consider the pollution to have happened at the time the incident took place.
This exception does not apply if any compulsory motor insurance law says we must provide this cover.

Guidance notes

We will not cover you if you or any driver does not meet all the conditions of this insurance.

We will not pay claims which occur as a result of the situations shown above.

The insurance does not cover you outside the United Kingdom, except to give the minimum cover needed in an EU country. To protect yourself fully while you are abroad, you should extend your cover. (Section 6, Driving abroad, has more information about this.)

We will not cover any proceedings outside the United Kingdom, unless they arise because your car has been used in a foreign country which we have agreed to extend this insurance to cover.

General conditions

What you must do

This insurance will only apply if:

  • the person claiming meets all the conditions in this document; and
  • all the information you have given us is correct and complete.

Your premium is based on the information you gave us when your cover started and when you renew it. If your circumstances change you must tell us as soon as possible.

If you don't give us full and accurate information, your insurance cover may not be valid or we may refuse to pay your claim.

 

Accidents and claims procedures

After any accident, injury, loss or damage, you must:

  • ring our call centre as quickly as possible on 0870-242-3300
  • send us every letter you receive about a claim unanswered, as soon as you can;
  • tell us as soon as you know about any prosecution, coroner's inquest or fatal accident inquiry;
  • not discuss any claim unless you have our permission in writing;
  • not do anything to harm our interests; and
  • give us all the help we may need to deal with a claim.

Handling a claim for you

We can:

  • take over, conduct, defend or settle any claim; and
  • take action (which we will pay for) to get back any money we have paid out under this insurance.

We will take this action in your name or the name of anyone else covered by this insurance. You or the person whose name we use must co-operate and give us all the information and help we may need.

Fraudulent claims

We will not pay a claim which is fraudulent, false, or exaggerated or where we have been given documents which are false or stolen. All cover under this insurance will end.

Right of recovery

If the law of any country which this insurance covers you in says we must pay a claim which we would not otherwise have paid, we can get back the money from you or the person who was using your car.

Care of your car

You or any other person covered by this insurance must:

  • protect your car from loss or damage; and
  • keep your car roadworthy;
  • you should not move or drive your car in a way likely to affect the safe driving or control of the vehicle or in a way which could cause loss or damage to it.

Your car must be covered by a valid Department of Transport test (M.0.T.) certificate if you need one by law.

Whenever the car is empty it must be locked and all the keys removed.

You must allow us to examine your car at any reasonable time.

Guidance notes

If you claim under this insurance, we can conduct the negotiations and settle the claim as we see fit.

You and anyone covered by this insurance must give us all the information and help we need.

We will not pay a claim which is fraudulent, false or exaggerated.

We can get back any money we have paid for a claim which this insurance would not normally cover.

You must keep your car efficient and roadworthy and take reasonable care to protect it from loss or damage.

Other insurance

If you claim for anything that is covered by another insurance, we will only pay our share of any amount you can't get back from the other insurance policy, up to the limits of this document.

Paying by instalments

If you do not pay one of your instalments on time, you must immediately pay all the remaining instalments even if you have separate credit arrangements with your insurance advisor. If you do not pay all the remaining instalments within seven days of writing to you, we will cancel your insurance immediately. You must then send us your certificate of motor insurance. As long as there has been no claim, we will refund any premium that covers the remaining period of insurance. We will not give any proof of your no claims bonus unless you have paid all the instalments.

Changing your policy

If we need to charge you an extra premium, we will usually collect this by adjusting the rest of your instalments. However, if we need to charge an extra premium near the end of the period of insurance, or after you have paid all the instalments, you must pay the extra premium straight away.

If a change results in a refund of premium, we will pay this by adjusting your remaining instalments. However, we may decide to make any refund through your insurance advisor.

If there is a claim under this insurance after it has been cancelled, we can:

  • get back any money you owe us;
  • deduct any money you owe us when we pay your claim; or
  • ask you to pay us back any money we have already paid.

If your car is written off you must pay whatever you owe us before we will pay your claim, or we may deduct what you owe us from anything we pay you.

Guidance notes

If you are covered by any other policy, we will only pay our share of what you can't claim from the other insurance.

If you pay your premium by instalments, it is important that you pay them on time. If any instalment is late, we will ask you to immediately pay all the outstanding premium. If you do not do this within seven days, we will cancel your insurance. If we do this, you will have no more insurance cover.

We have the right to get back any money you owe us.

Before we pay you for a car that is written off, we will take into account any money you owe us.

What to do if you need to alter your insurance

If your insurance has been arranged for you by an insurance advisor you should tell them about details of any changes.

Changing or adding a car to your insurance

If you change a car that is covered by this insurance or get an extra car, you must tell your insurance advisor before the cover can start for that car.

We will need to know the following.

  • The registration number.
  • The make and exact model of the car.
  • The engine size.
  • The value.
  • The year it was made.
  • Details of any changes that have been made to the car that are different from the manufacturer's standard specification.

We may ask you to send us your certificate of motor insurance. We will send you a new schedule with details of any new car we have agreed to insure and telling you about any change of premium. If you sell your car and do not need insurance, the cover will automatically end. If this happens you must send us the certificate of motor insurance.

Change of drivers

If you want to add a driver who is not covered by this insurance, please tell your insurance advisor immediately. You will have to fill in an additional drivers form giving details of the driver before cover can start. If we agree to cover a new driver, we will tell you about any change in your premium. We may ask you to send us your certificate of insurance. An extra premium may be required.

Moving home

Please give your insurance advisor your new address, and details of where your car is parked overnight as soon as possible. An extra premium may be required.

Driving abroad

If you pay an extra premium we will extend this insurance to cover your car while you are abroad. Please contact your insurance adviser at least two weeks before you leave.

Guidance notes

All cars covered by this insurance are shown in the schedule.

We must agree to any new car or you will not be covered.

We will tell you if there is any change in your premium.

We must agree to any new driver or that person will not be covered.

We need to know your new address so we can make sure that you get your renewal notice in good time. It will also help us if you need to make a claim.

Unless we extend your insurance while you are abroad, you will only have the minimum cover you need.

Section 6, Driving abroad, on page 19 has more information about this.

How to make a claim

The following information is to help you make a claim. It is not part of this insurance.

What to do after an accident

1 If you are involved in an accident, you must stop and ask the other people involved for the following information.

  • Their names and addresses.
  • Their insurance company's name and address and details of their policy or certificate number.
  • Vehicle registration numbers.
  • The names and addresses of all witnesses.

2 Do not admit that you are to blame or offer to pay for anything.

3 Do not sign anything at the scene of the accident.

4 Make a rough sketch of the accident scene showing the position of the cars before and after the accident. Include the positions of any parked cars, lampposts, telegraph poles and so on.

5 Report the accident to our claims call centre on 0870-242-3300 immediately. The call centre is open 8am to 8pm Monday to Friday and 9am to 4pm on Saturday.

6 You should send any letters or documents you receive about the accident to us as soon as possible. You must not reply to them.

What to do after a theft

1 Report the theft to the police immediately and make a note of their crime book reference number.

2 If you know where the vehicle is, make sure that it is safe and secure.

3 Report the theft to our call centre on 0870-242-3300.

Guidance notes

If an accident causes damage to another car, an animal or property, the law says you must stop. You should give your name, address and registration number to anyone reasonably asking.

If anyone else has been injured, you must show your certificate of insurance to the police or anyone reasonably asking.

You must tell our call centre about every accident you are involved in, even if you are not at fault, or do not intend making a claim.
You should always remove your personal belongings if your car is not driveable in case we remove your car to a safe place.

If you have Comprehensive cover

These are some of the benefits available to you

  • We have recommended repairers around the country who give a fast, reliable and professional repair service.
  • If your car can still be driven we will make arrangements for one of our recommended repairers to provide an estimate. You can take the car to them or they can collect it and return it to you after the estimate has been prepared. You can also arrange a date for the repairs to be started.
  • If the car cannot be driven, we will make arrangements for an engineer to look at your car. The engineer will arrange for a recommended repairer to collect your car, unless it is damaged beyond repair.
  • While your car is being repaired, the repairer may give you a free courtesy car, depending on whether one is available.
  • After your car has been repaired the repairer will return it to you in a clean and tidy condition.
  • Work done by recommended repairers is guaranteed.

Excess

If you have to pay part of the cost of repairing your car you must pay the repairer when you collect your car.

If your car is not driveable

We may remove your car to a safe place while it is waiting to be repaired or disposed of and you should remove all personal belongings.

Guidance notes

You should ring our claims call centre as soon as possible. They will fill in a claims form for you. This will be sent to you for signing. You should read it carefully and make any amendments you consider necessary and return the form.

Please have your policy number available when ringing the claims call centre.

Windscreen damage

Windscreens

If your insurance covers you for damage to your windscreen, you should use one of our approved repair or replacement companies. The freephone number for windscreen claims is 0800-716-333.

Remember to ask them if your windscreen can be repaired as this can save you money.

Guidance notes

Please have your certificate of insurance handy when you phone. We will be asking you for details of your certificate number.

You will not have to pay the excess which normally applies to a windscreen claim if the windscreen is repaired rather than replaced.

An endorsement only applies if it is shown in your schedule. Details of all endorsements are either shown in this section or on your schedule.

If an endorsement number in the schedule has an amount after it, the endorsement will be limited to the amount shown.

If an endorsement number has a car registration number after it, the endorsement will only apply to the car which has that registration number.

If an endorsement number has a person's name or a type of person after it, the endorsement applies only to that person or type of person.

The general terms, conditions and exceptions of this insurance also apply to any endorsements.

Endorsement number 1 - Restriction of cover to accidental damage, third party fire and theft only
Section 5 (Extra benefits) of this document does not apply.

We will not pay the first amount shown in the schedule for any claim under sections 2 and 3 of this document.

Endorsement number 13 - Fire and theft excess
We will not pay the first amount shown in the schedule for any claim under section 3 of this document. The amount shown after this endorsement number is on top of any other amount you may have to pay under this insurance.

Endorsement number 14 -'in all' excess
The young or inexperienced drivers excess shown in section 2 and the £100 excess in section 3 will not apply on top of the excess shown in endorsement number 12.

Endorsement number 15 - Excluding drivers
We will not cover your car while it is in the charge of anyone named after this endorsement number.

Endorsement number 16 - Private car benefits
The people named in the schedule will have the cover provided by section 5 (Extra benefits) of this document. If more than one person is making a claim under this section, we will divide the amount we will pay equally between them.

We will not cover you for legal costs under section 1, or for driving other cars under sections 1 or 8.

Endorsement number 17 - Excluding driving other cars
We will not provide cover for driving other cars under sections 1 or 8 of this document.

Endorsement number 18 - Excluding personal accident cover
Section 5 (Personal accident cover) of this document does not apply.

Endorsement number 19 - Suspension of all cover
All cover under this document is suspended until further notice.

Endorsement number 20 - Agreed value for the total loss of your car
If we pay you for the total loss (write off) of your car, we will pay the amount shown in the schedule.

Endorsement number 21 - No cover for theft unless it is in a garage or temporarily parked
We will not cover you for theft or attempted theft under section 3 of this document unless your car is in a locked garage or parked for a short time during a journey.

Endorsement number 22 - Suspension of cover other than fire or theft
Except for fire and theft covered by section 3, all cover is suspended.

Endorsement number 23 - Caravans or caravanettes
This insurance does not cover:

  • loss or damage caused by fire or explosion arising from the use of heating or cooking equipment;
  • loss or damage to the inside of the caravan or caravanette.

Endorsement number 24 - Cover for trailer
This insurance also applies to one trailer while it is attached to your car by a permanently-fixed towbar. Details of the trailer and its value must be given to and agreed by us before cover can start. We will not cover the contents of the trailer.

Endorsement number 25 - Additional benefits
We will provide cover under section 5 (Extra benefits) of this document to any person you allow to drive any car which is covered by this insurance.

Endorsement number 26 - Cover for cassette or stereo equipment
We will also provide cover under sections 2 and 3 of this document for any cassette recorder, compact disc player or stereo (but not cassettes, tapes, compact discs or records). Details of the equipment must be given to and agreed by us before cover can start. The most we will pay is shown after this endorsement number.

Endorsement number 27 - Extra windscreen cover
The limit of £200 in section 4 (windscreen cover) is replaced by the amount shown after this endorsement number.

Endorsement number 28 - Windscreen cover
This insurance also includes section 4 (windscreen cover) of this document.

Endorsement number 29 - Excluding commuting to and from work or study
We will not provide any cover while your car is in the charge of the person named after this endorsement number if they are using the car to travel to or from where they work or study.

Endorsement number 30 - All sections excess
We will not pay the first amount shown in the schedule for any claim under this insurance. By 'claim' we mean any money we pay for costs, fees or expenses.
The amount shown is on top of any other amount you may have to pay under this insurance.

Endorsement number 31 - Protected no claims bonus
If you pay an extra premium we will not reduce your no claim bonus if:

  • you do not claim more than once during any period of insurance; or
  • you do not claim more than twice during three continuous periods of insurance.

This benefit will stop if:

  • you make more claims than shown above; or
  • you no longer qualify for this benefit.

Endorsement number 33 - Damage excess
We will not pay the first amount shown in the schedule for any claim under section 2 of this document.
The amount shown after this endorsement number is on top of any other amount which you may have to pay.

Endorsement number 34 - Fire and theft excess for specified drivers
We will not pay the first amount shown in the schedule for any claim under section 3 of this document for an event which happens while your car is in the charge of anyone named after this endorsement number.

The amount shown after this endorsement number is on top of any other amount which you may have to pay under this insurance.

Endorsement number 35 - Limited mileage
We have reduced your premium because you have agreed that you will not do more than the number of miles shown in the schedule in any one period of insurance.

If you do more than this mileage you will have to pay the first £400 for any claim under sections 2 and 3 of this document.
The £400 is on top of any other amount which you may have to pay under this insurance.

Endorsement number 36 - Limited accidental damage cover
Section 2 (Cover for accidental damage) only covers the cost of essential replacement parts. We do not cover any labour charges.

Endorsement number 37 - Cover in the Republic of Ireland
This insurance will also apply while your car is temporarily in the Republic of Ireland during the period shown in the schedule.

Endorsement number 38 - Northern Ireland approved repairers' courtesy car
This insurance also applies to any courtesy car our approved repairers provide while your car is being repaired after an accident covered by this insurance.

If you make a claim for loss of or damage to the courtesy car you will have to pay:

  • any excess shown in sections 2 and 3 and in the schedule or on any endorsement applying to this insurance; or
  • the first £200 of any claim;

whichever is more.

Endorsement number 39 - Drinks and drugs clause
If an accident results in the person named after this endorsement number being convicted of an offence involving drink or drugs, the cover we provide for that accident is limited to section 1 (Liability to other people).

Endorsement number 40 - Lancaster agreed value for the total loss of your car
If we pay you for the total loss (write off) of your car, we will pay the value shown on your current Lancaster agreed valuation certificate. This endorsement will not apply if there is no Lancaster agreed valuation certificate in force.

Endorsement number 41 - No claims bonus removed
Section 7 (No claims bonus) of this document does not apply.

Endorsement number 42 - Cover for fixed radio phone equipment
We will also provide cover under sections 2 and 3 for permanently-fixed radio phone equipment. Details of the equipment must be given to and agreed by us before cover can start. The most we will pay is shown after this endorsement number.

Endorsement number 43 - Sale of food or drink
Section 1 (Liability to other people) does not apply to any claim arising from the preparation, sale or supply of food or drink from your vehicle.

Endorsement number 44 - Excluding fire and theft excess
The £100 excess in section 3 (Cover for fire and theft) of this document does not apply.

Endorsement number 45 - Warranted immobiliser fitted
We will not provide any cover under section 3 of this document for the theft or attempted theft of your car unless:

  • it is fitted with an insurance approved immobiliser or immobiliser alarm according to the manufacturer's instructions;
  • the immobiliser or immobiliser alarm is on and working whenever your car is left; and
  • we have proof that you have fitted an immobiliser or immobiliser alarm.

Endorsement number 46 - Warranted tracking device
We will not provide any cover under section 3 of this document for any theft or attempted theft of your car unless:

  • it is fitted with an insurance approved tracking device according to the manufacturer's instructions;
  • the tracking device is on and working whenever your car is left; and
  • we have proof that you have fitted a tracking device.

Endorsement number 47 - Cover for driving lessons
We will not cover:

  • anyone who is learning to drive, unless the car has dual controls;
  • your car while it is in the charge of someone who only has a provisional licence unless a qualified Department of Transport driving instructor is with them.

Endorsement number 48 - Damage excess for named drivers
We will not pay the first amount shown in the schedule for any claim under section 2 of this document for an event which happens while your car is in the charge of anyone named after this endorsement number.

The amount shown after this endorsement is on top of any other amount you may have to pay under this insurance.

Endorsement number 49 - Approved repairers' courtesy car
This insurance also applies to any courtesy car our approved repairers provide while your car is being repaired after an accident covered by this insurance. If you make a claim for loss of or damage to the courtesy car you will have to pay any excess shown in Sections 2 and 3 and in the schedule or on any endorsement applying to this insurance.

Endorsement number 63 - Increased audio cover benefits
The limit of £150 for fitted audio equipment referred to in this document is increased to £500 where the equipment is the manufacturer's standard fixture as supplied with the vehicle.
