So that you understand what you are covered for, please read this booklet, the schedule and certificate carefully. You should pay special attention to the general exclusions, the general conditions, and any endorsements. If any part of this documentation is incorrect of if your cover does not meet your needs or you have any questions, you should contact us or your insurance adviser. Guidance notes There are guidance notes throughout this booklet. They are not part of your insurance contract but they are there to help you understand it. Page 2 Your Insurance This document is a legally binding contract of insurance between you and us (Highway Motor Policies at Lloyd's and Highway Insurance Co. Ltd.). The contract is based on the information you gave us in the proposal form which you signed or a statement of fact that you have made. Highway Motor Policies at Lloyd's (HMP) and Highway Insurance Company Limited (HICO) are each responsible for a different percentage of this insurance. They do not have joint financial responsibility. Details of the proportions can be obtained on request to us. HMP is only ever liable for its percentage of this insurance and not for the separate liability of HICO. Similarly, HICO is only responsible for its individual proportion of liability and not for the separate cover given by HMP. We agree to insure you under the terms, conditions and exceptions contained in this booklet or any endorsements that apply to this booklet. You are insured for any liability, loss or damage that occurs during any period of insurance which you have paid, or agreed to pay a premium for. Unless we have agreed otherwise with you, this insurance is governed by English law. The certificate of motor insurance shows who may drive and describes what you may use your car for. Page 6 Section 1 - Your liability to other people We will insure you against everything you legally have to pay to claimants for damages costs and expenses if they arise from a claim caused by an accident while you are driving or in the charge of the insured car if.
Driving other cars If your certificate of motor insurance says so we will also insure you to drive any private car that you do not own and have not hired under a hire purchase or leasing agreement. However, we will not insure you against any loss of or damage to that car. Also we will not insure you in the following circumstances:
Other people We will also insure the following people.
Guidance notes We will insure you against claims made by other people for death, injury or damage to their property while you are driving or using your car. This section does not cover any loss or damage to the car you are using. We will also cover you if you are using someone else's car (but only if your certificate says you can). We will also insure other people while they are using your car (but only if your certificate says they can). Page 7 Legal costs If we agree in writing we will pay for the following legal fees if they arise from a claim caused by an accident that is covered under this insurance.
Emergency medical treatment We will pay for emergency medical treatment after an accident involving any car which this insurance covers. The Road Traffic Act says we must provide this cover. If this is the only payment we make, it will not affect your no claims bonus. By law the person who owns the car must pay the cost of emergency treatment. They should pass the bill for emergency treatment to us straight away along with a filled in accident report form. European Union (EU) compulsory cover We will provide the minimum insurance to allow you to use any car covered under this insurance:
If you need the full cover shown in the schedule, you must write and tell us about the journey you are going on. The Driving Abroad section on page 19 has more information about this. Guidance notes If we agree in writing, we will pay legal costs and expenses arising from a claim made because of an accident that is covered by this insurance. If we first agree in writing we will pay the solicitor's fee for representing or defending anyone we insure. We will pay the compulsory fee for emergency medical treatment after an accident. If we only pay a claim for emergency medical treatment this will not affect your no claims bonus. Your policy automatically gives you the minimum insurance you need to use your car in the EU and certain other countries. This minimum cover varies between countries. To make sure you have the full cover shown in the schedule, you should extend your cover when you travel abroad. The driving abroad section on page 19 has more information about this. Page 8 Towing We will insure you under this section while any car covered by this insurance is towing a caravan, trailer or broken-down car. The cover will apply as long as the towing is allowed by law, and the caravan, trailer or broken-down car is attached properly to your car by towing equipment manufactured for this purpose. This section of your insurance does not cover any of the following.
Guidance notes You can tow a caravan, trailer or a broken-down car. We only cover you for claims against you because of damage or injury arising from the towing. We do not provide any cover for loss of or damage to the caravan, trailer or broken-down car, or any of their contents. You must not tow for profit. Page 10 Section 2 - Cover for accidental damage
This cover applies only to the insured car.
Your contribution to a claim (the excess) - If an excess is shown in the schedule or on any endorsement that applies to this insurance, you will have to pay that amount for each claim you make. More than one excess may apply.
Young or inexperienced driver excess If your car is damaged while a young or inexperienced person is in charge of it, you will have to pay part of the cost of each claim as follows.
This excess is on top of any other excess which you may have to pay. We describe the terms, conditions and exceptions that apply to this section on pages 13 to 15 of this booklet. Guidance notes This section shows how we insure your car against loss or damage. As well as your car, this insurance covers your car's standard accessories and spare parts as long as you keep them in your car or garage. We also cover loss of or damage to audio equipment. The most we will pay is £150. The excess is the amount you have to pay for every claim for loss of or damage to your car. (For example, if your car costs £200, and you have a £50 excess you pay £50 and we pay £150.) More than one excess may apply. There are three kinds of excess.
Voluntary or compulsory excesses will be shown in your schedule and on any endorsement that applies to this insurance. The young or inexperienced driver excess will be on top of any other excesses which apply. You should read the terms, conditions and exceptions to this section at the same time as you read this section (see pages 13 to 15). Page 11 Section 3 - Cover for fire and theft damage This cover only applies to the insured car. We will cover you for loss of or damage to your car that is caused by:
This includes standard accessories and spare parts if you keep them in or on your car or in your garage. We will also pay up to £150 for loss of or damage to your cars' fitted audio equipment. This cover does not include tapes, cassettes, compact discs, citizen-band radios, phones or phone equipment. Your contribution or excess You must pay the first £100 if you claim under this section. This excess is on top of any other excesses which you may have to pay and which are shown in the schedule or on any endorsement that applies to this insurance. Theft If your car is stolen we will treat it as lost if you have still not got it back thirty days after you reported the theft to us. It must still be missing when we pay your claim. We need a letter from the police to say that you reported the theft as soon as you discovered it. You must also send us your car keys. If your car is stolen and you later get it back, you must tell us straight away. We describe the terms, conditions and exceptions that apply to this section in pages 13 to 15 of this booklet. Guidance notes This section covers you for loss of or damage to your car from fire or theft. We also cover you for damage caused by someone trying to steal your car. The excess is the amount you have to pay for every claim for loss of or damage to your car. (For example, if your car costs £250 to repair you pay £100 and we pay £150.) More than one excess may apply. You must report any theft to us as soon as possible. ('How to make a claim' on page 29 has more information about this.) It is important that you tell us straight away if you get your car back. You should read the terms, conditions and exceptions to this section at the same time as you read this section (see pages 13-15). We will not pay for the whole cost of any repair or replacement which leaves your car in a better condition than it was before the loss or damage. If this happens you will have to pay part of the cost of repair or replacement. Guidance notes These are the ways we can choose to pay your claim. The current market value of your car is the most we will pay. This is the cost of replacing your car with one of the same make, age and condition (but we will not pay VAT and excise tax). We will usually ask an engineer to give us advice on the value of your car if you make a claim. You will have to pay something towards a repair or replacement if your car is in a better condition after the work than it was before (for example, if we replace your worn tyres, exhaust or battery). Page 13 Financial interest If your car is part of a hire purchase or leasing agreement or belongs to someone else, we will normally settle your claim with the car's legal owner. Repairs after an accident or theft
Total loss (Write off) If we choose to pay you the market value of your car or the value of the car shown in the schedule you must send us the certificate of motor insurance ' the vehicle registration document and Department of Transport test (MOT) certificate if the car needs one and keys before we pay your claim. Once you accept our offer, this insurance will end for that car. The car then becomes our property. If we choose to treat your car as a write off, we may move it somewhere safe. Guidance notes If the car belongs to someone else or is hired or leased to you, we may settle your claim with the owner. Repairs can be arranged quickly. See 'How to make a claim' on page 29. If you can't drive your car, we will pay the cost of taking it to the nearest suitable repairer. We may arrange for your car to go to another repairer if we cannot agree repair costs with the garage you have chosen. If we treat your car as a write off, you must send us the documents we ask for before we will make any offer. Once you accept our offer for your car, this insurance will end for that car. Page 14 Exceptions to sections 2 and 3 Sections 2 and 3 of your insurance do not cover any of the following.
Guidance notes Loss or damage not covered under sections 2 and 3 is shown above. It is important to follow the vehicle manufacturer's instructions to avoid liquid freezing in your vehicle. You must take all reasonable precautions to avoid loss of or damage to your car. For example, you should take the keys out of the ignition and remove them completely when the car is empty and make sure that you do not leave possessions on display. You should close all the windows and lock all the doors. Always make sure that your immobiliser or alarm system is turned on if you have one and that you lock all your personal belongings in your boot. Page 15 Section 4 - Windscreen damage We will pay for damage to your car's windscreen or windows as long as there is no other damage to your car.
You must pay the first £50 if you claim under this section, unless you have your windscreen or window repaired. The most we will pay is:
Unless the windscreen is cracked, shattered or the driver's vision is affected we will not pay extra for the work to be done outside normal hours. If this is the only damage you are claiming for, your no claims bonus will not be affected. Guidance notes This section covers you for damage to glass in the windscreen or windows of your car if there is no other damage. You will have to pay the first £50 of any claim you make under this section, unless your windscreen or window is repaired. You can save money by having your windscreen repaired instead of replaced. When you contact the glass supplier, ask them to check the damage to see if it can be repaired. Details of the phone number of our approved glass repair or replacement organisations is on page 31. A claim under this section will not affect your no claims bonus. Page 16 Section 5 - Extra benefits 1 Personal accident cover If you or your husband or wife are injured or killed in a car accident, we will pay compensation. We will pay the amounts shown below if, within three months of the accident, it directly causes one of the following.
The most we will pay in any one period of insurance is £2,000.
We will pay the money to the injured person or to his or her legal personal representatives. If the injured person is insured by us under any other motor insurance, we will only pay out under one contract. This personal accident cover does not apply to any one of the following.
Guidance notes This section provides benefits for you if you or your husband or wife are killed or suffer serious injuries in a car. The most we will pay in any one period of insurance is £2,000. The restrictions on this cover are shown above. Page 17 2 Personal belongings We will pay up to £100 for personal belongings in your car, if they are lost or damaged because of an accident, fire, theft or attempted theft. If the property is owned by someone else, you can ask us to settle the claim with the owner of the property. This personal belongings cover does not apply to any of the following.
3 Medical expenses If you or your passengers are injured because of an accident involving your car, we will pay up to £150 for each person for any medical treatment. Guidance notes This section covers personal belongings in your car. The most we will pay is £100. We may settle a claim by paying the person who owns the property. Things that we don't cover are shown above. You must take reasonable care of your property. Do not leave it on show or in an unlocked or open car. We will pay the costs of medical treatment for anyone who is injured in your car. The most we will pay is £150 for each person. Page 18 Section 6 - Driving abroad Minimum cover We will provide the minimum insurance to allow you to use any car covered by this insurance:
This section does not include cover for 'Driving Other Cars' (see pages 7 and 21). Full cover abroad If you let us know before you go abroad and you pay an extra premium, we will extend the cover for your car for the time you are abroad. The insurance will then apply:
We will usually give you an international motor insurance certificate (Green Card). Cover for travel abroad does not apply to any of the following.
Guidance notes This section describes the cover that is available when you take your car abroad. The minimum cover automatically provided by this insurance varies from country to country. Unless you extend your cover by paying an extra premium, the cover you get is very restricted and will not include loss or damage to your car even if it would in this country. Please tell us well in advance of your trip if you want to extend the cover under your insurance. We will normally give you a Green Card which will show the countries we have agreed to provide cover for. A Green Card is recognised internationally. It will help you prove that you have the minimum insurance cover you need in any country shown on the Green Card. The restrictions on this cover are shown above. Page 19 Section 7 - No claims bonus If you do not claim under this insurance, and no claim has been made against you we will allow a bonus from your renewal premium if the insurance is renewed for another year. If the insurance covers more than one car, the no claims bonus will apply separately for each car. You cannot transfer your no claims bonus to another person. Guidance notes We will automatically allow a no claims bonus each year as long as you don't claim under your policy. This is a 'no claim bonus' and not a 'no blame bonus'. If we pay out under this insurance, we will reduce your no claims bonus even if an accident is not your fault (unless we get the money back from someone else). Page 20 Section 8 - General terms When your car is not in use If you want, you can reduce your insurance to cover loss or damage by fire or theft only. We will do this if your insurance cover is comprehensive or third party, fire and theft as long as:
In return for the reduced cover, if you renew your insurance with us we will give you back part of the premium you paid for the last period of insurance. The amount will be 75% of the premium for the time the policy was suspended. When we work out how much we owe you, we use the date we get your certificate of motor insurance. However, we will not give you a refund if you can't use your car because of the loss or damage you are claiming for. If this insurance covers more than one car, we will make any refund for each car separately.
Driving other cars If your certificate of motor insurance says you can, we will also cover you under Section 1 (Liability to other people) while you are driving any private motor car that you do not own and have not hired under a hire purchase or leasing agreement. We will not pay any claim under this section
Guidance notes You can reduce the cover under this insurance to cover loss or damage by fire or theft only. Your car must be out of use for at least four weeks and must not be kept on a public road at any time. The period of suspension will run from the date we get the certificate of motor insurance. We will only refund part of your premium if you renew your insurance with us. We will cover you for claims made for death or injury or damage to property if you are driving or using someone else's car (but only if your certificate of motor insurance says you can under the heading 'Persons or classes of persons entitled to drive'). Page 21 Cancelling your insurance You may cancel this insurance You may cancel this insurance at any time by telling us in writing and sending us your certificate of motor insurance. If you or someone else has not made a claim in the current period of insurance, we will refund part of your premium using the chart below. When we work out the time you have been covered by this insurance we use the period from the date the insurance started to the date we receive your certificate of motor insurance. Length of time you have had cover
We may cancel this insurance We or our authorised agent may cancel this insurance by sending you seven days notice to your last known address. If we do this we will refund part of your premium for the period of insurance left after the cancellation date: if you or someone else has not made a claim under this insurance. If we or our authorised agent cancel this insurance because you have not paid the premiums on time, we will not refund any part of the premium you have already paid. We will work out any outstanding premium charging for the time you have been covered by your insurance using the chart above. We will not pay any refund until we receive the certificate of motor insurance, or if you or someone else has made a claim under this insurance. We will not refund any of your premium if the insurance is cancelled following a claim where we choose to treat your car as a total loss (write off). Guidance notes If you want to cancel your insurance, we may refund some of your premium. We will only cancel your insurance from the day we receive your certificate of motor insurance. We may cancel your insurance by giving you seven days notice. It is an offence under the Road Traffic Act to keep your certificate after we have cancelled. You must tell us or your insurance adviser if you have lost your certificate of motor insurance. You will have to confirm in writing that you have lost it. Page 22 General exceptions These general exceptions apply to the whole of this insurance. Your insurance does not cover the following. 1 Any accident, injury, loss or damage that happens while any car covered by this insurance is:
2 Any liability that you have agreed to accept unless you would have had that liability anyway. Guidance notes These exceptions describe what your insurance does not cover. They apply to all sections of your insurance. Throughout this document you will also see exceptions which only apply to a particular section of your insurance. The certificate of motor insurance describes what you can use your car for and the people who are allowed to drive it. You must make sure any person who drives your car has a valid licence and meets all the conditions of it. For example, someone who only has a provisional licence must have a full-licence holder with them. You may not be covered if you accept any liability under an agreement for the use of your car. Please contact us before you enter into such an agreement. Your car must have a valid M.O.T.certificate and you may be asked to provide details to show your car was regularly maintained and kept in good condition. Page 23 3 Anyone who does not meet all the conditions of this insurance. 4 Any accident, injury, loss or damage caused directly or indirectly by:
5 Any liability, loss or damage that happens outside the United Kingdom (apart from the minimum cover described in section 6). 6 Any proceedings brought against you outside the United Kingdom, unless they result from using your car in a country which we have agreed to extend this insurance to cover. 7 Any liability, injury, loss or damage caused directly or indirectly by:
Unless the pollution or contamination is directly caused by one incident at a specific time and place during the period of insurance and is:
We will consider the pollution to have happened at the time the incident took place.
Guidance notes We will not cover you if you or any driver does not meet all the conditions of this insurance. We will not pay claims which occur as a result of the situations shown above. The insurance does not cover you outside the United Kingdom, except to give the minimum cover needed in an EU country. To protect yourself fully while you are abroad, you should extend your cover. (Section 6, Driving abroad, has more information about this.) We will not cover any proceedings outside the United Kingdom, unless they arise because your car has been used in a foreign country which we have agreed to extend this insurance to cover. Page 24 General conditions What you must do This insurance will only apply if:
Your premium is based on the information you gave us when your cover started and when you renew it. If your circumstances change you must tell us as soon as possible. If you don't give us full and accurate information, your insurance cover may not be valid or we may refuse to pay your claim.
Accidents and claims procedures After any accident, injury, loss or damage, you must:

We will take this action in your name or the name of anyone else covered by this insurance. You or the person whose name we use must co-operate and give us all the information and help we may need. Fraudulent claims We will not pay a claim which is fraudulent, false, or exaggerated or where we have been given documents which are false or stolen. All cover under this insurance will end. Right of recovery If the law of any country which this insurance covers you in says we must pay a claim which we would not otherwise have paid, we can get back the money from you or the person who was using your car. Care of your car You or any other person covered by this insurance must:
Your car must be covered by a valid Department of Transport test (M.0.T.) certificate if you need one by law. Whenever the car is empty it must be locked and all the keys removed. You must allow us to examine your car at any reasonable time. Guidance notes If you claim under this insurance, we can conduct the negotiations and settle the claim as we see fit. You and anyone covered by this insurance must give us all the information and help we need. We will not pay a claim which is fraudulent, false or exaggerated. We can get back any money we have paid for a claim which this insurance would not normally cover. You must keep your car efficient and roadworthy and take reasonable care to protect it from loss or damage. Page 26 Other insurance If you claim for anything that is covered by another insurance, we will only pay our share of any amount you can't get back from the other insurance policy, up to the limits of this document. Paying by instalments If you do not pay one of your instalments on time, you must immediately pay all the remaining instalments even if you have separate credit arrangements with your insurance advisor. If you do not pay all the remaining instalments within seven days of writing to you, we will cancel your insurance immediately. You must then send us your certificate of motor insurance. As long as there has been no claim, we will refund any premium that covers the remaining period of insurance. We will not give any proof of your no claims bonus unless you have paid all the instalments. Changing your policy If we need to charge you an extra premium, we will usually collect this by adjusting the rest of your instalments. However, if we need to charge an extra premium near the end of the period of insurance, or after you have paid all the instalments, you must pay the extra premium straight away. If a change results in a refund of premium, we will pay this by adjusting your remaining instalments. However, we may decide to make any refund through your insurance advisor. If there is a claim under this insurance after it has been cancelled, we can:
If your car is written off you must pay whatever you owe us before we will pay your claim, or we may deduct what you owe us from anything we pay you. Guidance notes If you are covered by any other policy, we will only pay our share of what you can't claim from the other insurance. If you pay your premium by instalments, it is important that you pay them on time. If any instalment is late, we will ask you to immediately pay all the outstanding premium. If you do not do this within seven days, we will cancel your insurance. If we do this, you will have no more insurance cover. We have the right to get back any money you owe us. Before we pay you for a car that is written off, we will take into account any money you owe us. Page 27 What to do if you need to alter your insurance If your insurance has been arranged for you by an insurance advisor you should tell them about details of any changes. Changing or adding a car to your insurance If you change a car that is covered by this insurance or get an extra car, you must tell your insurance advisor before the cover can start for that car. We will need to know the following.
We may ask you to send us your certificate of motor insurance. We will send you a new schedule with details of any new car we have agreed to insure and telling you about any change of premium. If you sell your car and do not need insurance, the cover will automatically end. If this happens you must send us the certificate of motor insurance. Change of drivers If you want to add a driver who is not covered by this insurance, please tell your insurance advisor immediately. You will have to fill in an additional drivers form giving details of the driver before cover can start. If we agree to cover a new driver, we will tell you about any change in your premium. We may ask you to send us your certificate of insurance. An extra premium may be required. Moving home Please give your insurance advisor your new address, and details of where your car is parked overnight as soon as possible. An extra premium may be required. Driving abroad If you pay an extra premium we will extend this insurance to cover your car while you are abroad. Please contact your insurance adviser at least two weeks before you leave. Guidance notes All cars covered by this insurance are shown in the schedule. We must agree to any new car or you will not be covered. We will tell you if there is any change in your premium. We must agree to any new driver or that person will not be covered. We need to know your new address so we can make sure that you get your renewal notice in good time. It will also help us if you need to make a claim. Unless we extend your insurance while you are abroad, you will only have the minimum cover you need. Section 6, Driving abroad, on page 19 has more information about this. Page 28 How to make a claim The following information is to help you make a claim. It is not part of this insurance. What to do after an accident 1 If you are involved in an accident, you must stop and ask the other people involved for the following information.
2 Do not admit that you are to blame or offer to pay for anything. 3 Do not sign anything at the scene of the accident. 4 Make a rough sketch of the accident scene showing the position of the cars before and after the accident. Include the positions of any parked cars, lampposts, telegraph poles and so on. 5 Report the accident to our claims call centre on 0870-242-3300 immediately. The call centre is open 8am to 8pm Monday to Friday and 9am to 4pm on Saturday. 6 You should send any letters or documents you receive about the accident to us as soon as possible. You must not reply to them. What to do after a theft 1 Report the theft to the police immediately and make a note of their crime book reference number. 2 If you know where the vehicle is, make sure that it is safe and secure. 3 Report the theft to our call centre on 0870-242-3300. Guidance notes If an accident causes damage to another car, an animal or property, the law says you must stop. You should give your name, address and registration number to anyone reasonably asking. If anyone else has been injured, you must show your certificate of insurance to the police or anyone reasonably asking. You must tell our call centre about every accident you are involved in, even if you are not at fault, or do not intend making a claim.

Excess If you have to pay part of the cost of repairing your car you must pay the repairer when you collect your car. If your car is not driveable We may remove your car to a safe place while it is waiting to be repaired or disposed of and you should remove all personal belongings. Guidance notes You should ring our claims call centre as soon as possible. They will fill in a claims form for you. This will be sent to you for signing. You should read it carefully and make any amendments you consider necessary and return the form. Please have your policy number available when ringing the claims call centre. Page 30 Windscreen damage Windscreens If your insurance covers you for damage to your windscreen, you should use one of our approved repair or replacement companies.
